Terms and Conditions

1. Scope and Legal Linkage.

These General Terms and Conditions apply to all orders placed with us and are accepted by the customer upon order formalisation.

2. Offer and Formalisation of the Order.

The Order shall be formalised upon the customer's payment of the initial deposit for the order, or the total purchase amount via bank wire, or upon placing the order through our website. Once the order is accepted, the customer may request a free copy of the invoice in paper and/or electronic format by emailing info@webofhydromassage.co.uk.

3. Delivery Timelines and Dates.

Delivery timelines are confirmed upon order placement. 

For items in stock, delivery timelines range from 7 to 15 business days, while for newly manufactured and custom-made items, delivery timelines range from 3 to 6 months, to be confirmed for each order. 

Delivery timelines for customised orders involving new manufacturing according to the customer's preferences may be subject to delays not attributable to our company, which, if they occur, will be justified to the customer, such as those related to maritime  transit. 

If the customer delays in formalising the order or making the agreed payment, the delivery date will be postponed for the time the customer has delayed. 

Web of Hydromassage does not guarantee deliveries on a specific day and time, as it is coordinated by the carriers. We reserve the right to freely choose the route and means of transportation. 

The transportation rate is to the doorstep unless otherwise expressly agreed upon through a quote, and it is assumed in advance that delivery trucks have sufficient space to carry the package to the destination street. When the customer arranges transportation, they assume the risk, and we are exempt from any responsibility for the merchandise.

4. Prices.

All our prices include VAT - except for companies, where the corresponding agreement will be reached via quotation.

5. Payment Method.

There are several payment options available for our customers:

Bank wire: A 40% advance payment is required as a deposit for the transaction. The remaining 60% will be paid when the product is ready for shipment to the customer's address, prior to the receipt of the merchandise and once its correct condition has been verified.

*Important: If requested, either at the time of placing the order or afterwards the remaining 60% payment can be made upon delivery of the merchandise, directly to the carrier. This option incurs a commission of 4% + VAT applied by the transportation company on the remaining 60% (or any other agreed-upon cost). According to current law, cash payments exceeding £1,000 (commission included) are not permitted, requiring payment via bank - check for such situations.

Online payment (1) "Paypal": This entails payment of 100% of the value plus [4,7% + £0,35] of the total, which is the commission charged by PayPal for each transaction.

Online payment (2) "Redsys": This is a completely secure payment option offered by almost all online stores (similar to PayPal). The customer enters their card details, and the cost is debited from their account. A receipt is issued to both parties within 24/48 hours, and the money is transferred. The full amount is paid, and we bear the commission.

Online payment through financing (3) "Postpone it": Split your payment into up to 37 monthly fees with a maximum financeable amount of £6,000 per person. Immediate, without paperwork (only the ID is necessary), and with an APR of around 15-20%. The customer adds the product to the shopping cart and selects the "Postpone it" option in the payment methods. At this point, they must choose the amount to finance, and upon completing the purchase process, the first agreed fee will be charged to the card.

6. Returns and Warranty.

Web of Hydromassage guarantees its products against any manufacturing defects for a period of 2 years from the date of delivery, excluding defects due to use such as digital components, taps, or lights, in which case the warranty period is 1 year. If the merchandise presents any manufacturing defects, Web of Hydromassage is committed to offer repair, replacement, price reduction, or contract resolution, free of charge for the customer. 

The natural wood skirts of the spas are designed for indoor use, not outdoor, therefore the warranty from Web of Hydromassage regarding this specific material is excluded. Hybrid models of wet sauna + dry sauna do not include flooring among their features, nor do the Turkish steam baths. For projects where machinery adaptation for the use of saltwater is requested, whether for bathtubs, spas or swimming pools, the adjustment will incur an additional charge quoted in each particular case and entails the installation of a different control panel, with PVC jets and does not include FM radio or CD connection.

In cases where the customer decides to embed their product into the ground (bathtubs, swimming pools and spas), we advise to concrete the hole and leave an essential perimeter access on all sides of the device for maintenance. The warranty of our products will be void in all cases where the installation procedures are not followed as described in the manuals provided with the product. Furthermore, it will not cover damages caused by misuse of our products, breakages or defects due to an improper assembly or wrong handling. 

As well as inadequate storage, installation or repair not performed by our Official Technical Service, in which case our liability will be limited to replacement of spare parts.

Web of Hydromassage reserves the right to minimally modify the structure and/or aesthetics of the products, while always maintaining the quality and similar technical characteristics, to improve the proper functioning of our products.

According to the Article 68 of Law 3/2014, of 27 March, customers may exercise their right of withdrawal from their order within 14 calendar days after receiving the product and request a refund of the amount paid in accordance with the deadlines established by law, without any costs to the consumer, who will receive a corresponding refund of the total purchase, that is, the price of the product plus shipping costs. 

The product must be packaged with the original packaging or in one of similar characteristics, in which case the item may suffer depreciation, and the return costs will be borne by the consumer. The customer has to place the product at the entryway of their residence where it will be collected by the carrier. The refund will be made through the same method by which the order was placed within 14 calendar days from the date on which the consumer and user has been informed of their decision to withdraw from the contract. 

In the event of exercising the right of withdrawal for customised orders involving the new manufacturing of an item according to the consumer's preferences, the customer will lose the amounts paid to the account up to that moment, since once the order is received by the customer, the orders are commissioned firmly for production and paid by our company in full.

Article 103 of the TRLGCU states that the right of withdrawal shall not apply to contracts related to:

(a) The provision of services, once the service has been fully performed, when the performance has begun with the prior express consent of the consumer and user and their acknowledgement that, once the contract has been fully performed by the trader, they will have lost their right of withdrawal;

(b) The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period;

c) The supply of goods made to the customer's specifications or clearly personalized;

(e) The supply of sealed goods which are unfit for return due to health protection or hygiene reasons and were unsealed after delivery;

7. Terms of Use, Receipt, and Maintenance.

For any operation, follow the instructions provided in the manual we give you upon receiving the product. Do not use products containing ammonia, solvents, organic, or abrasive substances for cleaning.

Upon receiving the merchandise, please ensure that the packaging is undamaged. If it were, you must clearly and concisely note this on the carrier's delivery receipt to prevent the evasion of the carrier's responsability. Additionally, inform us of this within 48 hours. Generic annotations, like 'pending review', will not be considered valid for future claims. After delivery, report any issues within a maximum of 72 hours.

8. Shipping costs.

Unless otherwise stated at the time of placing the Order, shipping costs are not included in the price and will depend on the weight and volume of each item, as well as the customer's location.

These General Conditions are governed by Spanish law. Additionally, in compliance with the provisions of the Alternative Dispute Resolution Law, we inform consumers that, as a member entity and under the terms of the Code of conduct, users may seek alternative dispute resolution through Confianza Online (https://www.confianzaonline.es/consumidores/como-reclamar/formularioreclamaciones/). If these refer to electronic transactions with consumers, or to data protection matters within this scope, the claims will be handled by the "Confianza Online" Mediation Committee, accredited for alternative dispute resolution in consumer affairs. Complaints related to digital advertising or data protection in this area, they will be referred to the Advertising Jury of AUTOCONTROL.
